Understanding Legal Aid

Anyone being interviewed under caution is automatically entitled to free legal advice from a criminal defence lawyer.

If your case goes to the Magistrate’s Court or Crown Court, then help with your costs, or Legal Aid as it’s known, may be available to you depending on the nature of the case and your financial circumstances.

You will be offered legal aid in the magistrate's court if...

  • You are under 18 years of age
  • You earn less than £12,475 per year
  • You receive Income Support
  • You receive Income-based Employment and Support Allowance
  • You receive Income-based Jobseeker’s Allowance
  • You receive Universal Credit
  • You receive State Pension Guarantee Credit
    AND
  • Your case passes the interests of justice test

Legal aid in the Crown Court

The system in the Crown Court is different.
