In recent years endless local and national authorities have geared themselves up to conduct prosecutions in the Criminal Courts. This may include prosecutions by the Dept of Business Innovation and Skills (BIS), Office of Fair Trading, the Financial Services Authority, the Health and Safety Executive, the Environment Agency, Defra, Local Authorities and many more. The Crown Prosecution Service has expanded its remit by taking under its aegis formerly separate prosecution agencies such as HMRC.
There are subtle but significant differences in the approach to defending Business and Regulatory Crime compared to that required for mainstream criminal defence. The work itself demands an intellectually rigorous approach based as it is upon the application and interpretation of statutory instruments and regulation, many of which are only infrequently tested in Court.
